General Terms & Conditions

All goods and services sold by www.brommieplus.com are subject to the following conditions. 

1. DEFINITIONS:
  • The COMPANY means www.brommieplus.com as operated by Top Wheels Holding Corp. whose registered office is at 9-2, 250 Zhongxiao E. Road, Taipei, Taiwan, R.O.C. 106.
  • The PURCHASER or YOU” means any person or company who buys or has agreed to buy goods from the Company.
  • The GOODS means any goods or services supplied by the Company,
  • The CONDITIONS means the terms and conditions set out in this document.

2. APPLICABLE TERMS:
All contracts for the sale of Goods shall be subject to the Conditions. Contract between the Company and Purchaser is deemed created at the time the order is placed with contract details stated in writing in the Order Confirmation.

3. PRICES:
The prices for the Goods are stated in the Company's Order Confirmation, and remain fixed for the transaction. Thereafter the Company reserves the right to vary the prices without notice.

4. PACKING, SHIPPING AND INSURANCE:
Packaging, shipping and insurance to designated address of the Purchaser shall be paid by the Purchaser and shall be charged at the Company's rates current at the time of order acceptance.

5. PAYMENT:  
The Company requires payment in full for price of the Goods and delivery services prior to dispatching to the Purchaser.
If the Purchaser fails to make any payment when due then, without prejudice to any other right or remedy available to the Company, the Company shall be entitled to terminate the contract and suspend any further deliveries to the Purchaser;
 
6. DELIVERY:
The Goods shall be delivered to the address stated in the Order Confirmation. In case of PayPal payment, Goods will be delivered to address provided by PayPal. All deliveries will be completed within 30 days of receipt of order - unless otherwise agreed. If delivery cannot be completed within these timescales, then option to cancel and refund will be given. Risk in the Goods shall pass to the Purchaser upon delivery to the address.  The Purchaser is required to use delivery services that are traceable, requiring signature upon delivery, and insured.
 
7. RETURNS:
Goods supplied may not be returned for credit or refund without prior notification to the Company and any Goods which are returned without such notification may be refused. Goods much be returned postage prepaid in original condition and packing to receive refund of purchase price. Depending on the reason for return, shipping charges may not be refundable.
Custom ordered Goods are not refundable.
 
8. EXCHANGE:
Goods supplied may be exchanged within 7 days of delivery to the Purchaser. The Purchaser shall notify the Company prior to returning the Goods with postage prepaid. The return postage, depending on the reason for exchange, may not be refundable. Exchange for dissimilar goods will be processed as returns and new purchases.

9. CANCELLATION/CHANGE OF PURCHASE ORDER:
Order may be changed or cancelled before the Goods have been dispatched. After the Goods have been dispatched, any changes in the purchase order will be processed as a return.

The Company reserves the right to cancel any order without notice upon a reasonable suspicion of fraud or other abuse.

10. DAMAGE IN TRANSIT:
The Company shall not be liable for Goods damaged in transit unless notified within 7 day from the receipt of the damaged goods by the Purchaser. To initiate the claim, the Purchaser must demonstrate such damage to have arisen prior to delivery to the purchaser's premises.

11. FAULTY OR DEFECTIVE GOODS:
Any claim by the Purchaser which is based on a product defect shall be notified to the Company within 7 days from the date of delivery or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after the discovery of the defect or failure. Following notification the Company will issue a refund, if a repair, replacement, or the issue a credit note in respect of defective Goods is not acceptable to the Purchaser. The Purchaser must retain the Goods with the original packing for inspection and return them, carriage paid and at the risk of the Purchaser to the Company.
Cosmetic blemishes or imperfections are not considered defects.
 
12. NOTIFICATION OF SHORTAGE OR WRONG ITEMS:
The Company shall accept no liability for shortage of Goods on delivery unless written notification shall have been received by the Company from the Purchaser within 7 days of delivery of the Goods to the Purchaser.
 
13. CUSTOMER LIABILITY:
The Company shall not be liable for any loss or damage whatsoever caused directly or indirectly by the Purchaser's failure to perform any of the Purchaser's obligations under any contract or order relating to any Goods or any other matter wholly or partly within the Purchaser's control.

14. ASSIGNMENT:
No contract with the Company, nor any rights arising thereof, shall be assignable by the Purchaser without the prior written consent of the Company.

15. PRODUCT LIABILITY:
Any warranty expressed or implied, whether statutory or otherwise (including conformity with description, fitness for purpose or quality) are hereby expressly excluded except in respect of death or personal injury caused by the Company's negligence. The Company shall be under no liability whatsoever for consequential loss or damage arising from the goods sold, repair, converted, or for service rendered.

16. FORCE MAJEURE:
The Company is not liable for delay in delivery or failure to deliver Goods arising out of any cause whatsoever beyond its reasonable control such as acts of God, civil unrest, riots, drought, flood, fire, earthquakes, and government actions.

17. LAW & JURISDICTION:
All contracts made between the Company and the Purchaser shall be construed in accordance with and governed in all respects by Taiwanese Law and the Purchaser agrees to submit to the exclusive jurisdiction of Taiwanese Courts.
